The draft allocation formula agreements that have been prepared to implement the ACF and ACT River Basin Compacts are both substantively and procedurally flawed. They are substantively flawed in that they attempt to do indirectly what the states have been precluded from doing directly. They are procedurally flawed in that that their development did not include full participation by all relevant stakeholders. These inadequacies and related issues are examined in the context of applicable federal legal requirements.
